Consumer Terms and Conditions
Effective date: 28th of November 2017
These Consumer Terms and Conditions (the “Terms”) constitute a legal agreement between Globetrotter Enterprises Pte Ltd having a registered address at 140 Robinson Road, Singapore 068907 and the Consumer (as defined below). By using the Services (as defined below), you agree to be legally bound by these Terms. In case you do not agree with one or more provisions of these Terms, please do not use the Services. You are authorized to use the Services only if you agree to these Terms.
1. Terms and Definitions
Except to the extent expressly provided otherwise, in these Terms:
“Consumer”, “you”, and “your” means the consumer of the Services provided by the Company.
“WunderPass”, “we”, and “us” means the company Globetrotter Enterprises Pte Ltd having a registered address at 140 Robinson Road, Singapore 068907.
The “Account” means a free of charge user account registrable on the Website.
The “Card” means a pass provided by WunderPass in a physical or electronic form, which allows the Consumer to redeem rewards when the Card is presented to Merchants.
The “Fees” means recurring fees payable for the Membership plans.
The “Membership” means membership plans that allow Consumer to use the full functionality of the Services and enjoy additional benefits, such as redeeming more Rewards and opting for exclusive Rewards.
The “Merchants” means providers of goods and services (e.g., travel, food, drink, shopping, entertainment, and events providers) affiliated with WunderPass.
The “Publishers” means writers who submit reviews about the goods and services offered by the Merchants.
The “Rewards” means compensations received by the Consumer when the Card is presented to merchants listed on the Website.
The “Services” means all services provided by WunderPass to the Consumer, including, but not limited to, accessing the website http://www.wunderpass.com and associated software applications, receiving the Card, registering an Account, and the opportunity to purchase paid Membership plans.
The “Terms” means these Consumer Terms and Conditions and any amendments to these Terms.
The “Third Parties” means any natural or legal persons not affiliated with WunderPass, the Merchants, and the Consumers.
The “Third Party Payment Provider” means a payment processor processing any payments related to the Services, including the Fees.
The “User-Generated Content” means any content submitted by the Consumer on the Website, including text, photos and videos.
The “Website” means the website http://www.wunderpass.com operated by WunderPass as well as the software applications associated with it.
The “WunderPass’ Content” means the intellectual property owned by WunderPass, such as source code, object code, software content, copyrights, logos, business names, trademarks, and patents related to the Services.
2. Scope of the Terms
These Terms regulate the relationship between WunderPass and the Consumer only. These Terms do not regulate the relationships between (i) WunderPass and the Merchants and (ii) WunderPass and the Publishers. The relationships between (i) WunderPass and the Merchants and (ii) WunderPass and the Publishers are governed by separate agreements.
3.1 Although WunderPass communicates with Merchants, WunderPass does not itself provide Rewards. WunderPass shall not be liable if a Merchant refuses or fails to honour Rewards. The following terms apply to the Rewards:
(i) the Rewards can be received only when the Card is presented to Merchants;
(ii) the Rewards may vary from time to time and you should confirm the availability of any particular Reward with the Merchant prior to using the Card;
(iii) unless otherwise specified by the Merchant, you are not allowed to combine your Rewards with other services (e.g., vouchers, third party certificates, coupons, or promotions) offered by Merchants, retailers, commercial ventures or other Third Parties;
(iv) you are not allowed to sell or trade Rewards;
(v) unless otherwise provided by the Merchant, you cannot receive more than one (1) Reward per redemption; and
(vi) you agree that each Merchant may, at its sole discretion, adopt terms and conditions related to the redemption of Rewards. You further agree that you will need to comply with such terms and conditions in order to redeem your Reward.
3.2 Rewards will be deemed void if they are redeemed in circumstances not consistent with these Terms.
4. Requirements for using the Services
4.1 In order to use the Services, you need cumulatively to: (i) be at least 13 years of age and have the authority to legally bind yourself to these Terms (either on your own or by having a parent or legal guardian who agrees to the terms set forth herein on your behalf); and (ii) register an Account on the website or subscribe for a Membership. The Membership will allow you to use the full functionality of the Services and enjoy additional benefits, such as redeeming more Rewards and opting for exclusive Rewards.
4.2 The Services must be used for their intended purpose and you shall not use the Services for the benefit of any Third Party except as specifically contemplated in these Terms. You must use the Services for personal use only. You agree not to display, distribute, licence, perform, publish, reproduce, duplicate, copy, create derivative works from, modify, sell, resell, exploit, transfer or transmit for any commercial purpose, any portion of the Services, use the Services, or access to the Services unless otherwise expressly stated herein. You shall be responsible for defending and indemnifying WunderPass at your own expense from and against any claims, damages, liabilities and/or expenses arising out of your breach of any of your obligations outlined in this section.
4.3 You shall not engage or use any data mining, robots scraping or similar date gathering or extraction methods in relation to the Services.
5. Amendments of the Services
WunderPass has the right to amend on a temporary or permanent basis the Services with or without any notice to you. By registering an Account or subscribing for a Membership, you agree that WunderPass will not be responsible to you or any Third Party for any amendment of the Services.
6. Account and Membership
6.1 Registration of an Account
6.1.1 To start using the Services, you are required to create an Account on the Website. You can do so free of charge by: (i) clicking on the button “Sign Up” located on the top left corner of the Website; (ii) submitting your contact details in the contact form; and (iii) clicking on the button “Sign up now”. After your request is processed, you will get a confirmatory email.
6.1.2 You are not allowed to register more than one Account and your Account is not transferrable.
6.2 Cancellation of the Account
6.2.1 You can cancel your Account at any time (i) through your user interface available on the Website or (ii) by contacting Wunderpass by email at email@example.com.
6.2.2 Wunderpass may, in its sole discretion, cancel your Account and terminate your use of the Services if we have a reason to believe that your use of the Services violates these Terms and it is appropriate, necessary or desirable to do so. We will notify you at least 3 business days prior such a cancellation.
6.2.3 The cancellation of your Account will result in a complete erasure of your data about your use of the Services. If your Account is cancelled, Wunderpass will: (i) deactivate and permanently delete your Account; and (ii) terminate all your rights granted by these Terms. Please note that your data cannot be recovered after the cancellation of the Account is executed.
6.3 Signing up for a Membership
6.3.1 Wunderpass provides you with an opportunity to subscribe for paid Membership plans, including, but not limited to, monthly, annual and multi annual Membership plans, subject to paying Membership Fees. The Membership entitles the Consumer to receive multiple benefits, such as redeeming more Rewards and opting for exclusive Rewards.
6.3.2 In order to subscribe for a Membership, please click on the button “Become a member” located on the top left corner of the Website; (ii) submit your contact details in the contact form; and (iii) click on the button “Sign up now”. After your request is processed, you will get a confirmatory email.
6.3.3 By subscribing for a Membership, you agree to pay the applicable recurring Fees and comply with the payment conditions set out in these Terms.
6.4 Cancelling your Membership
6.4.1 After the subscription period for your Membership expires, you have the right to cancel your Membership. You can do so (i) through the user interface available on the Website or (ii) by contacting Wunderpass by email at firstname.lastname@example.org. Please note that, by cancelling the Membership, you will lose the right to all exclusive benefits associated with the Membership.
6.4.2 You can cancel your paid Membership plan by notifying WunderPass prior to the expiration term of the paid Membership. After you notify WunderPass of your intent to cancel your paid Membership, the paid Membership will automatically continue until the end of the subscription period. After the expiration of the subscription period, your paid Membership will not automatically renew. Please note that, in case you cancel your paid Membership before the expiration date of your Membership, you will NOT be entitled to any refund of the Fees, including Fees paid for partially used periods.
6.5 Trial period. WunderPass may, but has no obligation to, provide the Consumers with a limited trial Membership period. The information about the availability of the trial period and applicable terms and conditions will be made available on the Website and/or any marketing material provided by WunderPass. WunderPass may ask you to provide your payment information for signing up for the trial period. Please note that WunderPass will not charge you any Fees during the trial period. After the expiration of the trial period, you will be automatically enrolled for the Membership and the Fees will be charged in accordance with your chosen Membership plan and the Fee schedule available at ______. Please note that (i) WunderPass will not inform you about the expiration date of the trial period and (ii) it is your sole responsibility to check the duration and other terms and conditions of the trial period before subscribing for the trial period. If you would like to opt out from the trial period before its expiration date, you can do so through your Account or by contacting WunderPass by email at email@example.com.
6.6 The details of your specific contract will not be filed by us and, therefore, the specific contract will not be available to you. However, if you do require any information regarding your Membership, please contact us by using the contact details mentioned in Section 29 “Contact us” of these Terms.
6.7 By registering an Account, subscribing for a Membership, or a trial Membership, you agree to provide only accurate and up-to-date information about yourself. You agree to update your Account or Membership information as soon as any changes in your contact information occur to ensure that your Account is up-to-date, true, accurate, current, and complete.
6.8 By registering an Account, subscribing for a Membership, or a trial Membership, you warrant that you have read and agree to these Terms and comply with the conditions set therein, including age restrictions.
6.9 It is your responsibility to maintain the confidentiality of your Account and Membership login details, including your password and username. Further, you are fully responsible for all activities that occur under your Account or Membership. If you observe any unauthorised use of your login details or any breach of security, you have a responsibility to notify WunderPass immediately. On witnessing these unauthorised activities, you must immediately log out from the Website. If you fail to comply with this section, WunderPass will not be liable for any loss or damage that arises from these unauthorised activities.
6.10 You acknowledge that it is your responsibility to use a secure encrypted connection to communicate with WunderPass and use the Services.
7. License to use the Website
7.1 Subject to the provisions of these Terms, WunderPass hereby grants you a non-transferable, non-exclusive, revocable, limited licence to access and use the Website pursuant to these Terms.
8. User-Generated Content
8.1 WunderPass is not responsible for any User-Generated Content, which you make publicly available on the Website, e.g., your comments. You are solely responsible for your User-Generated Content.
8.2 You are prohibited to post on the Website any User-Generated Content that contains:
(i) false information;
(ii) information that contains explicit or graphic descriptions or accounts of sexual acts, including, without limitation, sexual language of a violent or threatening nature directed at another individual or group or individuals;
(iii) any inside information and/or proprietary or confidential information learned or disclosed under nondisclosure agreements;
(iv) any information that infringes upon the intellectual property rights of any Third Parties;
(v) any information that contains software viruses or any other computer code, files or programs that are designed or intended to disrupt, damage, or limit the functions of any software, hardware, or telecommunications equipment or to damage or obtain unauthorised access to any data or other information of any other Third Party;
(vi) any information that does not comply with the applicable laws.
8.3 By posting any User-Generated Content, you hereby grant and will grant WunderPass and its affiliated companies a nonexclusive, worldwide, royalty free, fully paid up, transferable, sublicenseable, perpetual, irrevocable license to copy, display, transmit, perform, distribute, store, modify and otherwise use your User-Generated Content in connection with the provision of the Services or the promotion, advertising or marketing thereof, in any form, medium or technology now known or later developed.
8.4 You acknowledge that any User-Generated Content posted by you on the Website is non-confidential.
8.5 WunderPass reserves the right, in its sole discretion, to remove any User-Generated Content, terminate your Account, and your access to the Website.
8.6 If you are of the opinion that your intellectual property rights have been violated by User-Generated Content posted on the Website, please contact us at the address stated in Section 29 and provide WunderPass with the following information in English:
(i) a signature of the person authorised to act on behalf of the owner of the copyright or other intellectual property interest;
(ii) a description of the copyrighted work or other intellectual property which you allege infringes your rights;
(iii) a description of where the material is located on the Website;
(iv) your address, telephone number, and email address;
(v) a statement by you that you have a good faith belief that the disputed use is not authorised by the copyright or intellectual property owner, its agent, or the law;
(vi) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorised to act on the copyright or intellectual property owner's behalf.
9. The Card
9.1 Each Consumer is entitled to receive the Card by mail or electronically after registering an Account.
9.2 In conjunction with the Card, there will be personalised login access information provided, which will give exclusive access to the Consumers’ only area of the Website.
9.3 A Consumer must present the Card to a specific Merchant listed on the Website to redeem benefits/awards.
9.4 The Card is not redeemable for cash.
9.5 You agree not to hold WunderPass liable if your Card is stolen, lost, or damaged. Neither WunderPass nor the Merchants shall be responsible for the malfunctioning of a Card that is lost or stolen.
9.6 The Card is non-transferable. You are not allowed to sell it or transfer it to other people.
9.7 To the extent permitted by the applicable law, WunderPass disclaims all liability arising out or in connection with your use of the Card.
10. Third Parties
10.1 WunderPass allows you to register for the Services via services provided by Third Parties (e.g., Facebook).
10.2 Once you have enabled Third Parties (e.g., Facebook) to access your Account, you are granting WunderPass the authority to pass your log-in information to these Third Parties.
10.3 The manner in which the Third Parties use, store and disclose your information is governed solely by the privacy policies of each Third Party.
10.4 WunderPass is not liable for any damage or loss caused by or in connection with your use of any services offered by Third Parties.
10.5 Under no circumstances shall WunderPass be liable in any way for any content posted by Third Parties.
10.6 WunderPass reserves the right, in its sole discretion, to remove any content published on the Website by Third Parties.
10.7 Unless WunderPass expressly states in writing to the contrary, WunderPass neither endorses nor adopts as its belief any content posted by Third Parties.
10.8 WunderPass may publish on the Website links to websites operated by Third Parties. WunderPass does not endorse any Third Parties’ websites. WunderPass shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any content contained in such Third-Parties’ websites. We would like to inform you that WunderPass has made no attempt to verify any information contained in, nor has any control over, such websites.
10.9 Please note that you also may be subject to additional terms and conditions that may apply when you use services offered by Third Parties.
11. WunderPass' Content
11.1 You acknowledge that WunderPass owns WunderPass’ Content, such as source code, object code, software content, copyrights, logos, business names, trademarks, patents and other intellectual property related to the Services.
11.2 Unless otherwise stated in these Terms or WunderPass’ prior written consent has been obtained, you possess no licence or right to use any of WunderPass’ Content.
11.3 All suggestions, recommendations, bug-fixes, error-fixes or other communications from you to WunderPass regarding the Website shall, upon submission to WunderPass be owned solely and exclusively by WunderPass.
11.4 WunderPass’ Content is protected by the intellectual property laws of the Republic of Singapore and the applicable international intellectual property treaties.
11.5 WunderPass may provide information in articles published on the Website. Such articles shall not be regarded as professional advice. WunderPass shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any content contained in such articles.
12. Indemnity and Release
To the extent permitted by the applicable law, you agree to release, indemnify and hold WunderPass and its affiliates and their officers, employees, directors and agent harmless from any and all losses, damages, expenses, including reasonable attorneys’ fees, rights, claims, actions of any kind and injury (including death) arising out of or relating to your use of the Services and any User-Generated Content.
13. Limitation of Liability
13.1 To the extent permitted by the applicable law, WunderPass shall not, under any set of circumstances, be liable to you for ANY special, incidental, indirect, punitive or consequential damages, including, but not limited to, loss of profits or data, arising out of your use of the Services whether based in contract, tort or any other legal theory, even if advised of the possibility of such damages. This includes damages, which may result from:
(i) the use or inability to use the Services;
(ii) unauthorised access to your data by Third Parties;
(iii) unauthorised alteration to your data by Third Parties;
(iv) any statements and/or conduct of Third Parties; and
(v) any other matter relating to the Services.
13.2 It is important to note that some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Therefore, some of the aforementioned limitations may not apply to you.
13.3 In no event shall WunderPass’ total liability to you for all damages, losses or causes of action exceed the amount you have paid WunderPass in the last six (6) months, or, if greater, fifty United States dollars (USD 50).
13.4 In the event you are dissatisfied with these Terms, your sole remedy is to discontinue your use of Services.
14. Disclaimer of Warranties
14.1 You undertake to use the Services at your own risk. To the extent permitted by the applicable law, WunderPass expressly disclaims ALL warranties or ANY kind, whether expressly, implied or statutory including, but not limited to the implied warranties or merchantability fitness for a particular purpose, title and non-infringement.
14.2 WunderPass undertakes no warranty:
(i) that the quality of the Services will meet your expectations and/or requirements;
(ii) that the Services will be timely, secure or error-free;
(ii) that the results provided by the Services will be accurate or reliable.
14.3 You hereby agree and acknowledge that:
(i) WunderPass shall not be responsible for any actions taken by any Third Party;
(ii) WunderPass does not recommend or endorse any Third Parties hereunder, and makes no representations or warranties whatsoever regarding any such Third Party;
(iii) WunderPass is not a party to any transaction between you and any store, retailer or business with which WunderPass has a business relationship, and as such, any disputes regarding purchases, rewards and/or any other aspect of any transaction or other commercial dealings is solely between you and such Third Party; and
(iv) WunderPass is not responsible for any other party’s compliance with applicable laws, rules or regulations.
14.4 By using the Services and the Website, you acknowledge that WunderPass may use third party suppliers to provide software, hardware, storage, networking, and other technological services. The acts and omissions of third party suppliers may be outside of WunderPass’ control. To the maximum extent permitted by law, we exclude any liability for any loss or damage resulting from the acts and omissions of such third party suppliers.
15. Term and Termination
15.1 These Terms are in force from the effective date indicated at the beginning of these Terms until terminated.
15.2 If WunderPass believes that you have violated or acted inconsistently with these Terms, WunderPass has a sole discretion to suspend or terminate your Account, your Membership or your use of the Services for any reason whatsoever. This termination may arise without prior notice and WunderPass reserves the rights to deactivate your Card and/or immediately terminate:
(i) your Account;
(ii) your license to use the Website; and
(iii) all of your related Rewards.
15.3 WunderPass may decide to terminate your use of the Services if it believes you have acted fraudulently, abusively, or illegally. Subsequently, it may refer to the appropriate law enforcement authorities.
15.4 WunderPass shall not be liable to you or any Third Parties for any termination of your access to the Services.
15.5 We reserve the right, at our sole discretion, to terminate these Terms at any time with or without a prior notice to you.
15.6 After the termination of these Terms, all legal rights granted to you pursuant to these Terms will terminate. Upon termination, you shall stop using the Services.
16. Fees, Payments, and Refunds
16.1.1 All Fees are displayed on the Website in the Fee schedule available at ____ or communicated to you in writing.
16.1.2 The Fees are displayed in United States dollars (USD) and include all applicable taxes.
16.1.3 The Fees remain valid as long as they are indicated on the Website or communicated to you in writing. The Fees are subject to change. In case the Fees change, WunderPass will notify you at least 30 days in advance by sending an email or sending you a notice through the Website. Unless otherwise specified by WunderPass in writing, the changes of the Fees will apply to your next recurring payment.
16.1.4 The Fees do not include Internet access charges. You are solely responsible for paying Internet usage charges to your chosen Internet provider.
16.2.1 Unless you notify the Company about your wish to cancel your Membership, your Membership will automatically renew on a basis related to your Membership plan (e.g., monthly basis, annual basis, and multi annual basis). The Fees for the renewed Membership will be charged on the 1st day of the period (e.g., a month or a year) to which the renewed Membership relates.
16.2.2 During the first month of using the Services, the Fees will be charged pro-rata in conjunction with the Fees for the next month.
16.2.3 All payments related to the Services, including the Fees, will be processed by the Third Party Payment Processor. You agree that we shall not be liable if the Third Party Payment Processor declines or refuses your payment.
16.2.4 You agree not to hold the WunderPass liable for payments that do not reach the correct account because you have quoted an incorrect account number or incorrect personal information.
16.2.5 The Third Party Payment Processor may collect from you payment information, which will allow it to make the payments requested by you. Please note that we neither store nor process your credit/debit card information. The Third Party Payment Processor handles all the steps in the payment process on its website, including data collection and data processing.
16.2.6 Unpaid Fees. If the Third Party Payment Processor does not succeed to charge the Fees from you, WunderPass may terminate your Membership. Please note that, if your Membership is terminated due to the failure to charge you (e.g., due to insufficient funds or changes in your payment information), you will remain liable for any Fees due to you within your Membership period in addition to any attorney fees and other costs incurred due to the necessity to collect the Fees.
16.3 Refunds. The Fees paid by you for the Membership are NON-REFUNDABLE. Unless otherwise required by law, WunderPass will not provide any refunds of the Fees paid by you for using the Services, including the Fees for partially used periods. We may, but have no obligation to, at our sole discretion, provide you with a partial refund of the Fees. If you are unsatisfied with the quality of the Services, please contact WunderPass by using the contact details mentioned in Section 29 “Contact us” of these Terms.
16.4 Promotional codes. From time to time, WunderPass may, at its sole discretion, make available promotional codes, including promotional codes made available by Third Parties. The information about the availability of promotional codes and applicable terms and conditions will be made available on the Website and/or any marketing material provided by WunderPass. Third party promotional codes may be subject to additional terms and conditions. Please note that promotional codes can only be used once.
17. User Disputes
17.1 WunderPass is not responsible for interactions between users of the Website in relation to the Services.
17.2 WunderPass is not responsible for interactions between users of the Website and Third Parties in relation to the Services.
17.3 Further, WunderPass will have no liability or responsibility regarding disputes arising out or related to the interactions mentioned in Section 17.1 and Section 17.2.
For the purposes of these Terms, the term “Confidential Information” refers to information marked by WunderPass as confidential. All Confidential Information of WunderPass is to be treated in confidentially. Such Confidential Information is not to be used for any purpose other than for using the Services. No Confidential Information is to be disclosed to any Third Party except as reasonably required in these Terms.
You must refrain from directly or indirectly soliciting, enticing, persuading or inducing any individual who is then, or has been within 1-year period prior to the applicable date, an employee of WunderPass to terminate employment with WunderPass or to become employed by another individual or entity.
21.1 Any controversy or claim arising out of or relating to these Terms, or the breach thereof, shall be settled by arbitration unless resolved mutually.
21.2 Unless otherwise agreed by the parties, arbitration will be held in Singapore before a single arbitrator mutually agreed upon by the parties. The arbitration must commence within forty-five (45) days of the date on which a written demand for arbitration is filed by either party. The arbitrator’s decision and award shall be made and delivered within sixty (60) days of the conclusion of the arbitration and within six (6) months of the selection of the arbitrator. The arbitrator will not have the power to award damages in excess of the limitation on actual compensatory, direct damages set forth in these Terms and may not multiply actual damages or award punitive damages or any other damages that are specifically excluded under these Terms, and each party hereby irrevocably waives any claim to such damages. The arbitrator may, in his or her discretion, assess costs and expenses (including the reasonable legal fees and expenses of the prevailing part) against any party to a proceeding. Any party refusing to comply with an order of the arbitrators will be liable for costs and expenses, including attorneys’ fees, incurred by the other party in enforcing the award.
21.3 Any party refusing to comply with an order of the arbitrators will be liable for costs and expenses, including lawyers’ fees, incurred by the other party in enforcing the award.
21.4 You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of these Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred.
21.5 A printed version of these Terms and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
22. Amendment of the Terms
WunderPass reserves the right to amend these Terms from time to time, each of which amendment shall be deemed to be effective on the effective date indicated at the beginning of these Terms and in Section 30 of the Terms. WunderPass may, but has no obligation to, inform you about such amendments through your Account or by email. In order to ensure you are up-to-date with any changes, it is your responsibility to frequently check the Terms posted on the Website.
23. Availability and Force Majeure
23.1 We put reasonable efforts to ensure that the Services are always available. Nevertheless, we cannot guarantee that the Services would be always available because the availability of the Services may be affected by factors, which we cannot control, e.g., bandwidth problems, equipment failure, or force majeure events. We do not accept any responsibility for the unavailability of the Services caused by such factors.
23.2 In respect of circumstances beyond WunderPass’ control, WunderPass shall not be liable to you for failure or delay in performing any obligations hereunder.
24. Governing Law
These Terms shall be governed by the laws of the Singapore without regard to its conflict of law provisions. With respect to any disputes or claims not subject to arbitration, as set forth above, you and WunderPass agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within Singapore. The failure of WunderPass to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
25. Entire Agreement
These Terms and any other terms and conditions available on the Website constitute the entire agreement between you and WunderPass and govern your use of the Services, superseding any prior agreements between you and WunderPass with respect to the Services.
